SHIPPING

Delivery is by express courier usually within 20 (twenty) working days of receipt of payment. Casastar di Gianluca Salpietro accepts orders only with shipping in Europe. Every other case has to be singularly checked and could involve higher shipping costs.

For each order placed on the Portal, Casastar di Gianluca Salpietro will issue an invoice or receipt of the goods sent. For the issuance of the tax document, the information provided by the Customer at the time of the order shall prevail. Once the tax document has been issued, it will not be possible to make changes to it.

Except for specified promotions on the e-commerce, the shipping costs, indicated on the website, are charged to the Customer and are clearly shown to the customer when the order is placed. Nothing is owed more by the customer than the total order that also includes shipping costs. The e-commerce indicates the estimated timing for order fulfilment and the delivery of purchased goods to the customer. In any case Casastar di Gianluca Salpietro will not take care of the shipment or of the goods of the order when it is carried out by a professional carrier (express courier) as indicated in the portal and no responsibility can be attributed to Casastar di Gianluca Salpietro in case of delay by the courier or in relation to any other event or circumstance related to the shipment of the goods by the courier.

At the time of delivery of the goods by the courier, the customer is required to check that:

– the number of packages delivered corresponds to that indicated on the invoice;

– the packaging is intact, undamaged, wet or otherwise altered, even in the sealing materials (adhesive tape or strapping).

Any damage to the packaging and / or the product or the mismatch in the number of packages or indications, must be immediately notified to the courier, subject to written control reserve (specifying the reason for the reservation, eg “packaging laundry”, “packaging crushed “, etc.) on the courier delivery test. Once the courier’s document has been signed, the Customer cannot make any objection regarding the external characteristics of the goods delivered.

Any problems related to physical integrity, correspondence or completeness of the products received must be reported within 3 days of delivery, according to the procedures provided for in this document.

In the case of non-delivery due to the absence of the recipient, to the address indicated by him in the order, the courier will leave a notice and try again a second time; if the recipient is still absent, the goods will be returned to the sender (Casastar di Gianluca Salpietro) with the shipping and delivery costs charged to the customer.

 

COMMUNICATIONS AND RIGHT OF WITHDRAWAL

Except on special offers.

Any communication concerning the contract must be sent to: Casastar di Salpietro Gianluca Via Solferino 10 – 04100 Latina, Italy, by registered letter with return receipt or by e-mail to amministrazione@casa-star.it, the written form is qualified essential for the validity of such communications.

According to Legislative Decree 206/2005 and subsequent amendments/additions the consumer has the right to revoke the order proposal; for the exercise of this right, the consumer can send a written communication to the seller’s premises: CASASTAR DI SALPIETRO GIANLUCA Via Solferino 10 – 04100 Latina also using the form in Annex I part B of Legislative Decree 211/2014 . The communication must be sent by registered letter with acknowledgment of receipt within 14 days from the date of signing this order note in the case of service contracts or from the day on which the consumer (or a third party other than the carrier and designated by consumer) acquires physical possession of goods in the case of sales contracts. This communication can be sent, within the same period, also by telegram, telex, email and fax, provided it is confirmed by registered letter with acknowledgement of receipt within the following forty-eight hours. The consumer is required to return the good, intact, to CASASTAR DI SALPIETRO GIANLUCA Via Solferino 10 – 04100 Latina, without undue delay and in any case within 14 (fourteen) days from the date on which he announced his decision to withdraw from the contract. Return costs are charged to the consumer.

The prices in force at the time of the order are considered valid. All prices include VAT.

Pursuant to articles 52 and following of Legislative Decree 206/05, if the customer is a Consumer, he has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty.

In order to exercise this right, the customer, within 14 (fourteen) days from the date of receipt of the goods, must send to Casastar di Gianluca Salpietro a written communication exclusively through the appropriate function on the website.

Following the exercise of the right of withdrawal in the manner provided by art. 11.2 of these terms of sale, the customer is required to return the goods to Casastar di Gianluca Salpietro within the term of 14 (fourteen) days from the date of receipt of the goods to Casastar by Gianluca Salpietro. The product must be returned to Casastar di Gianluca Salpietro, complete with all accessories, instruction manuals and all that was originally delivered to the customer, as well as packed in its original packaging. A copy of the electronic receipt of the order must be attached to the returned product. The costs of returning the goods to Casastar by Gianluca Salpietro are charged to the customer.

According to the paragraph 1 of the art. 56 of Legislative Decree 206/05, Casastar di Gianluca Salpietro will refund all payments received by the customer without undue delay In the event that the goods are returned, Casastar di Gianluca Salpietro will, pursuant to paragraph 3 of the art. 56 of the Consumer Code,  credit the customer the amount only after the return of the goods and only after verifying the integrity of the same. The refund will be made by bank transfer, it will be the customer’s responsibility to promptly provide the bank details on which to obtain the reimbursement (IBAN and holder of the current account). In case of payment by PayPal or credit card, the refund will be made on the same PayPal account used for the purchase. Casastar di Gianluca Salpietro has no power to intervene in relation to the timing of crediting that is at the discretion of the bank or referenced institution.

The right of withdrawal is, however, subject to the following conditions:

– the right applies to the product purchased in its entirety, it is not possible to exercise withdrawal only on part of the product purchased;

– the right does not apply to customized products or clearly personalized;

– the purchased article must be intact and returned in its original packaging, complete in all its parts (otherwise, pursuant to paragraph 2 of article 57 of Legislative Decree 206/05, the customer will be responsible for the value of the goods, resulting different from the normal use, characteristics and functioning of the product);

– upon its arrival in the warehouse, the product will be examined to assess any damage or alterations not caused by transport.

In the event of lack of conditions for the valid right of withdrawal, the goods will remain at the Casastar di Gianluca Salpietro headquarters available to the Customer for collection at his exclusive charge.

 

GUARANTEE

All products sold by Casastar di Gianluca Salpietro are covered by the manufacturer’s standard warranty if any, and by a guarantee of 24 (twenty-four) months for conformity defects, according to Legislative Decree 206/05. To use the warranty, the customer must keep the invoice. The 24-month warranty pursuant to Legislative Decree no. 206/05 applies to the product that presents a lack of conformity, provided that the product itself is used correctly, respecting its intended use and any attached technical report. This guarantee is reserved for the private consumer. In case of lack of conformity, Casastar di Gianluca Salpietro provides, without expenses for the Customer, to restore the conformity of the product by replacing the product with a new one or, in the event of stock exhaustion, of equivalent characteristics and commercial value.

In the cases where the return of the product is provided for the application of the guarantees, the goods must be returned by the customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment). EXPRESS RESOLVED CLAUSE

In case of non-payment of all or part of the purchase price of the goods, Casastar di Gianluca Salpietro reserves the right to declare, according to and for the purposes of art. 1456 of the civil code, resolved this contract by sending a written communication to the customer’s email.
